Terms and Conditions for Fornzix Online Courses

These Terms and Conditions (“Terms”) govern the purchase of, enrollment in, access to, and use of online courses, training programs, examinations, instructional materials, and related services offered by Fornzix (“Fornzix,” “we,” “us,” or “our”) through the Fornzix learning management system and associated websites (collectively, the “LMS”).

By purchasing a course, enrolling a student, creating an account, accessing course content, or selecting an option indicating acceptance of these Terms, the purchaser and the student agree to be bound by these Terms.

1. Purchasers and Students

For purposes of these Terms:

A “Purchaser” is the individual, agency, business, organization, or other entity that purchases access to a course.
A “Student” is the individual authorized by Fornzix to access and participate in the course.
The Purchaser and Student may be the same person.
When an organization purchases access for one or more Students, both the organization and each Student are subject to these Terms.

Purchasing a course does not transfer ownership of the course or any course content to the Purchaser, Student, employer, sponsoring agency, or any other person or organization.

2. Limited Course License

Upon receipt of payment and approval of enrollment, Fornzix grants the Student a limited, personal, revocable, nonexclusive, nontransferable license to access and use the purchased course solely for the Student’s individual education and professional development.

This license:

Is provided only to the specifically authorized Student;
Does not permit use by coworkers, employees, students, trainees, contractors, family members, or other third parties;
Does not transfer ownership of any intellectual property;
Does not permit the Student or Purchaser to teach, reproduce, distribute, publish, display, modify, or create derivative materials from the course; and
Ends when course access expires, the course is completed, the account is terminated, or access is otherwise withdrawn under these Terms.

All rights not expressly granted are reserved by Fornzix.

3. Ownership of Course Content

All course content is owned by Fornzix or used by Fornzix with permission. Course content may include, without limitation:

Written lessons and instructional text;
Videos, recordings, narration, and presentations;
Photographs, fingerprint images, footwear images, diagrams, illustrations, and graphics;
Case examples, demonstrations, exercises, assignments, and scenarios;
Examination and quiz questions;
Answer keys and instructor explanations;
Course organization, sequencing, and instructional methods;
Handouts, worksheets, checklists, reference materials, and downloadable files;
Software demonstrations, screenshots, interfaces, and documentation;
Logos, trademarks, trade names, and branding; and
Any other materials displayed, provided, or made accessible through the LMS.

Course enrollment or purchase provides temporary access to the content. It does not constitute a sale, assignment, or transfer of the content or any copyright, trademark, trade secret, or other intellectual-property right.

The Purchaser and Student receive no ownership interest in the course or its content, regardless of the price paid, the amount of the course completed, or whether the Purchaser is an individual, government agency, educational institution, laboratory, law-enforcement agency, or private organization.

4. Prohibited Copying and Reuse

Except where Fornzix provides express written permission or applicable law expressly permits otherwise, the Purchaser and Student may not:

Copy, reproduce, photograph, scan, print, download, archive, or save course content;
Screen-record, audio-record, livestream, broadcast, or otherwise capture any part of a course;
Take screenshots of course videos, lessons, examinations, demonstrations, or restricted instructional materials;
Share account credentials or permit another person to access the Student’s account;
Email, upload, post, publish, distribute, transmit, or provide course content to another person;
Place course materials on a shared drive, intranet, server, cloud-storage service, document-management system, or agency network;
Use course materials to conduct internal, commercial, governmental, or public training;
Incorporate course content into another course, presentation, lesson plan, policy, procedure, manual, report, article, website, software product, or publication;
Modify, translate, adapt, summarize, repackage, or create derivative works from course content for distribution or reuse;
Remove, conceal, crop, or alter copyright notices, watermarks, branding, attribution, metadata, or access controls;
Sell, sublicense, rent, lend, assign, or commercially exploit course content;
Use course content to develop a competing course, product, service, or training program;
Submit course content to an artificial-intelligence system, machine-learning system, dataset, language model, automated transcription service, or content-generation platform for training, analysis, reproduction, or generation of similar material;
Attempt to bypass security measures, download restrictions, enrollment limits, or access-expiration controls; or
Assist another person or organization in performing any prohibited act.

Notes taken personally by a Student for the Student’s own private study are permitted, provided those notes do not substantially reproduce the course and are not distributed, published, used to teach others, or used for commercial purposes.

Any materials specifically identified by Fornzix as downloadable may be downloaded and used only for the personal educational use of the authorized Student. Downloadable status does not grant permission to distribute, teach from, publish, or commercially reuse those materials.

5. Organizational and Agency Purchases

When an agency, laboratory, educational institution, company, or other organization purchases a course:

Each enrollment is limited to the number of Students purchased;
Each Student must have a separate authorized account unless Fornzix expressly approves another arrangement in writing;
The organization may not place the course in its own LMS, training library, intranet, document repository, or shared network;
The organization may not retain or reuse Fornzix content to train future personnel;
A supervisor may not display a Student’s course to a classroom, workgroup, or meeting unless a group-training license has been purchased; and
A Student’s departure from the organization does not automatically permit transfer of the enrollment to another person.

Seat transfers, substitutions, or group-use permissions require prior written approval from Fornzix and may be subject to additional fees.

6. Course Access Period and Expiration

Course access is temporary. The applicable course description, order confirmation, enrollment notice, or purchase agreement will identify the access period or completion deadline.

Unless expressly stated otherwise in writing:

Access begins when the Student’s enrollment is activated;
Access ends when the Student completes the course or when the stated access period expires, whichever occurs first;
Access may end automatically without additional notice;
Completion of a final examination, issuance of a certificate, or satisfaction of all required lessons may be treated as completion of the course;
After access ends, the Student will no longer be able to view lessons, videos, exercises, examinations, course history, or other course content; and
The Purchaser or Student is responsible for completing the course and downloading any authorized certificate before access expires.

Expiration of access does not transfer ownership of the course content and does not create a right to continued access.

Fornzix is not required to extend access because of scheduling conflicts, workload, vacation, illness, personnel changes, failure to begin the course promptly, failure to complete the course, computer problems under the Student’s control, or misunderstanding of the access deadline.

Fornzix may, at its discretion, offer an extension for an additional fee or under other stated conditions. Any extension must be confirmed in writing by Fornzix.

7. Account Security

Students must provide accurate registration information and maintain the confidentiality of their usernames, passwords, and account credentials.

Students agree to:

Use only their assigned account;
Maintain a secure password;
Notify Fornzix promptly of suspected unauthorized access;
Log out when using a shared or public computer; and
Accept responsibility for activity occurring through their accounts.

Fornzix may use reasonable technical measures to detect account sharing, unusual login activity, excessive device use, simultaneous sessions, prohibited downloading, screen capture, automated access, or other violations.

Fornzix may suspend an account while suspected misuse is investigated.

8. Student Conduct

Students must use the LMS professionally and lawfully. Students may not:

Harass, threaten, impersonate, or abuse another person;
Upload unlawful, defamatory, infringing, discriminatory, obscene, or malicious material;
Introduce malware, harmful code, automated bots, scraping tools, or unauthorized software;
Attempt to access another user’s account or restricted system areas;
Interfere with the operation, security, or availability of the LMS;
Manipulate course progress, attendance records, quiz results, or completion data;
Obtain or distribute examination answers through unauthorized means;
Complete coursework, examinations, or assignments for another Student;
Allow another person or an artificial-intelligence system to complete graded work on the Student’s behalf; or
Misrepresent identity, attendance, course completion, qualifications, or examination performance.

9. Examinations and Academic Integrity

Unless expressly permitted by the instructor, quizzes, examinations, assignments, and practical exercises must be completed independently by the enrolled Student.

Students may not copy, photograph, record, memorize for distribution, publish, sell, or provide examination questions or answers to another person.

Fornzix may invalidate scores, withhold certificates, require retesting, suspend access, or terminate enrollment when cheating, impersonation, unauthorized assistance, or examination-content disclosure is suspected.

10. Certificates and Continuing Education

A certificate issued by Fornzix confirms only that the Student completed the requirements identified for that particular course.

Unless expressly stated otherwise, a certificate:

Is not an academic degree;
Is not a professional license;
Is not a government certification;
Does not establish competency in every aspect of the subject;
Does not guarantee employment, promotion, assignment, certification, or acceptance of continuing-education credit;
Does not authorize the Student to represent that the Student is certified by Fornzix; and
Does not replace agency-required training, supervised practical experience, competency testing, proficiency testing, certification, or continuing education.

Students and Purchasers are responsible for determining whether a course satisfies the requirements of an employer, agency, court, professional association, certification body, licensing authority, or continuing-education provider.

Fornzix may revoke or correct a certificate obtained through error, fraud, account sharing, cheating, misrepresentation, or violation of these Terms.

11. Forensic and Professional Training Disclaimer

Fornzix courses are provided for educational and professional-development purposes. Course content does not constitute legal advice, laboratory accreditation advice, case-specific consultation, or a substitute for applicable laws, regulations, court decisions, accreditation requirements, professional standards, agency policies, laboratory procedures, technical procedures, manufacturer instructions, or supervisory direction.

Forensic practices and requirements may differ by jurisdiction, agency, laboratory, accrediting body, discipline, and case circumstance.

Students remain responsible for:

Following their agency’s or laboratory’s approved procedures;
Working within the scope of their training, authority, and competency;
Obtaining required supervision or technical review;
Verifying that methods are appropriate for a particular case;
Maintaining proper documentation and quality-assurance practices; and
Complying with applicable legal, ethical, scientific, and professional requirements.

Fornzix does not guarantee that a method, conclusion, report, image, process, or technique discussed in a course will be accepted by a particular court, agency, laboratory, accrediting body, or professional organization.

12. Course Descriptions and Updates

Fornzix attempts to describe courses accurately. Course outlines, instructors, examples, software interfaces, exercises, reference materials, availability, and content may be updated when reasonably necessary.

Fornzix may make nonmaterial changes without notice. If a material change prevents delivery of the principal course purchased, Fornzix may provide replacement content, an alternative course, an access extension, or another reasonable remedy.

Fornzix does not guarantee that every course will remain available indefinitely.

13. Technology Requirements

The Student is responsible for having:

A compatible computer or mobile device;
A supported and reasonably current web browser;
Reliable internet service;
Functional audio and video capabilities when required;
Permission to access the LMS through the Student’s organization or network; and
Any software identified in the course description.

Fornzix is not responsible for problems caused by unsupported devices, outdated browsers, employer firewalls, blocked websites, local network restrictions, insufficient bandwidth, third-party extensions, or equipment under the Student’s control.

Scheduled maintenance, service interruptions, security events, hosting failures, or circumstances beyond Fornzix’s reasonable control may temporarily affect access. When reasonably practical, Fornzix may provide additional access time for a substantial LMS outage caused by Fornzix or its service providers.

14. Prices, Payment, and Taxes

Course prices are displayed at the time of purchase. The Purchaser agrees to pay the stated price and any clearly disclosed applicable taxes or authorized charges.

Access may be withheld, suspended, or terminated when:

Payment is declined, reversed, disputed, or not received;
A chargeback is submitted without a good-faith attempt to resolve the matter;
An invoice becomes overdue; or
The purchase was made through fraud or unauthorized payment information.

A purchase provides only the license and access rights described in these Terms.

15. Refunds, Cancellations, and Transfers

Purchases are subject to the refund and cancellation policy displayed at checkout or provided in the applicable order, proposal, invoice, or purchase agreement.

Unless a different written policy applies, the following default policy will govern:

A refund request must be submitted within 5 calendar days after purchase;
No refund will be issued after the Student has accessed more than 1% of the course, completed an examination, downloaded restricted materials, or received a certificate;
No refund will be provided because the Student failed to complete the course before the access deadline;
No refund will be provided for an account terminated because of a violation of these Terms;
Approved refunds will be returned through the original payment method when reasonably possible; and
Enrollment transfers require prior written approval and may be denied after course access has begun.

Nothing in this section limits any nonwaivable right provided by applicable law.

16. Privacy and Student Information

Fornzix may collect and process information reasonably necessary to administer purchases, accounts, course progress, examinations, certificates, technical support, security, and legal compliance.

Use of personal information is also governed by the Fornzix Privacy Policy. If an organization purchases a course for a Student, Fornzix may provide that organization with reasonable enrollment information, including course status, completion status, examination status, scores when applicable, and certificate information.

Students should not upload confidential case information, personally identifiable information, criminal-justice information, protected health information, evidentiary material, or sensitive agency information unless Fornzix has expressly authorized the upload and appropriate safeguards are in place.

17. Third-Party Services and Links

The LMS may include links to third-party websites, publications, software, videos, products, or services. Such references are provided for convenience or instructional context.

Fornzix does not control and is not responsible for third-party content, availability, privacy practices, security, accuracy, pricing, or terms. A reference to a third party does not necessarily constitute an endorsement.

Students are responsible for reviewing and complying with the terms applicable to third-party services they choose to use.

18. User-Submitted Content

If a Student submits an assignment, comment, question, image, document, or other material through the LMS, the Student retains ownership of material the Student lawfully owns.

The Student grants Fornzix a limited license to access, store, reproduce, and review submitted material as reasonably necessary to operate the course, grade or evaluate work, provide support, maintain records, enforce these Terms, and comply with law.

The Student represents that submitted material:

May lawfully be provided to Fornzix;
Does not infringe another person’s rights;
Does not contain unauthorized confidential or protected information; and
Does not violate agency policy, court order, protective order, or applicable law.

Submission of a Student’s original work does not give the Student any ownership interest in Fornzix course content incorporated into an assignment, form, exercise, or examination.

19. Copyright and Intellectual-Property Complaints

A person who believes material available through the LMS infringes that person’s copyright or other intellectual-property rights should contact Fornzix through the contact information provided on the Fornzix website and include:

Identification of the protected work;
Identification and location of the allegedly infringing material;
The complaining party’s contact information;
A statement explaining the basis of the complaint; and
Any additional information reasonably requested by Fornzix.

Fornzix may remove or restrict access to disputed material while reviewing a complaint.

20. Suspension and Termination

Fornzix may suspend, restrict, or terminate an account or enrollment when the Purchaser or Student:

Violates these Terms;
Shares an account or course content;
Copies, records, distributes, or misuses course content;
Attempts to circumvent access controls;
Engages in cheating, impersonation, or fraud;
Fails to make required payment;
Threatens the security or operation of the LMS;
Misuses another person’s intellectual property or confidential information; or
Engages in unlawful or abusive conduct.

When reasonably appropriate, Fornzix may provide notice and an opportunity to correct a violation. Immediate action may be taken for serious, repeated, fraudulent, infringing, or security-related conduct.

Termination for violation of these Terms may occur without refund. Termination does not limit any other rights or remedies available to Fornzix.

Sections concerning ownership, prohibited use, payment obligations, disclaimers, limitation of liability, indemnification, dispute resolution, and other provisions that by their nature should survive will remain effective after termination.

21. Enforcement of Intellectual-Property Rights

Unauthorized copying, recording, distribution, publication, teaching, commercial use, or creation of derivative materials may cause substantial harm to Fornzix.

Fornzix may use available legal and equitable remedies to address actual or threatened violations, including:

Suspension or termination of course access;
Removal of unauthorized materials;
Demands to cease use or distribution;
Recovery of damages and other relief available under applicable law; and
Recovery of reasonable costs or attorneys’ fees when authorized by law or agreement.

Failure by Fornzix to enforce a provision in one instance does not waive the right to enforce it later.

22. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LMS, COURSES, CERTIFICATES, AND COURSE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

FORNZIX DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND UNINTERRUPTED AVAILABILITY.

FORNZIX DOES NOT WARRANT THAT:

The LMS will always be available, secure, or error-free;
Every error or interruption will be corrected;
A Student will pass an examination or successfully complete a course;
A course will satisfy a particular employer, agency, licensing, accreditation, or certification requirement;
Course participation will result in employment, promotion, financial benefit, professional recognition, or case acceptance; or
Course content will be suitable for every jurisdiction, case, agency, laboratory, or professional purpose.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.

23. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORNZIX AND ITS OWNERS, OFFICERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST OPPORTUNITIES, BUSINESS INTERRUPTION, EMPLOYMENT CONSEQUENCES, OR PROFESSIONAL OR CASE-RELATED OUTCOMES ARISING FROM OR RELATING TO THE LMS, A COURSE, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORNZIX’S TOTAL LIABILITY ARISING FROM OR RELATING TO A PARTICULAR COURSE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO FORNZIX FOR THAT COURSE DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot lawfully be limited or excluded.

24. Indemnification

To the extent permitted by law, the Purchaser and Student agree to defend, indemnify, and hold harmless Fornzix and its owners, officers, employees, instructors, contractors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable expenses arising from:

The Purchaser’s or Student’s violation of these Terms;
Unauthorized copying, recording, distribution, or reuse of course content;
Material uploaded or submitted by the Student;
Misrepresentation of course completion or qualifications;
Unlawful or improper use of the LMS; or
Infringement of another person’s rights.

An organization’s indemnification obligations are subject to any limitations imposed by applicable law.

25. Honest Reviews and Feedback

Students and Purchasers may provide honest reviews, comments, and feedback about their experience with Fornzix.

Nothing in these Terms prohibits or penalizes an honest review, a legally protected report to a government agency, participation in a legal proceeding, or another communication protected by applicable law.

This provision does not authorize disclosure or reproduction of copyrighted course content, examination materials, confidential information, trade secrets, or another person’s private information.

26. Accessibility and Accommodations

Fornzix seeks to provide reasonably accessible online training. A Student requiring an accommodation should contact Fornzix as early as reasonably possible and describe the requested accommodation.

Fornzix will consider reasonable accommodation requests based on the course format, available technology, and applicable law. An accommodation does not include permission to copy, distribute, publish, or provide course content to unauthorized persons.

27. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law applies or applicable law requires otherwise.

Before filing a legal action, the parties agree to make a good-faith effort to resolve the dispute informally by providing written notice describing the dispute and requested resolution.

Unless applicable law requires another location, any legal proceeding arising from these Terms shall be brought in a court of competent jurisdiction located in the California county in which Fornzix maintains its principal place of business.

Nothing in this section prevents Fornzix from seeking immediate injunctive or equitable relief to prevent unauthorized access, disclosure, copying, distribution, or misuse of its intellectual property.

28. Changes to These Terms

Fornzix may update these Terms to reflect changes in courses, technology, business practices, or legal requirements.

The revised Terms will be posted through the LMS or Fornzix website with an updated revision date. When required, Fornzix will provide additional notice or obtain renewed acceptance.

Changes will not retroactively alter a material purchase term unless agreed by the affected party or permitted by law.

29. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable. The remaining provisions will continue in effect.

30. No Waiver

A delay or failure by Fornzix to exercise a right or enforce a provision does not waive that right or provision. A waiver is effective only when made in writing by an authorized representative of Fornzix.

31. Assignment

The Purchaser or Student may not assign or transfer an enrollment, account, license, or right under these Terms without prior written approval from Fornzix.

Fornzix may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, transfer of a course or business operation, or similar transaction.

32. Entire Agreement

These Terms, the applicable course description, order confirmation, invoice, purchase agreement, refund policy, and Privacy Policy constitute the agreement between the parties concerning the LMS and course purchase.

If a separately signed written agreement conflicts with these Terms, the separately signed agreement controls to the extent of the conflict.

33. Contact Information

34. Acceptance

By purchasing, enrolling in, accessing, or using a Fornzix course, the Purchaser and Student acknowledge that they:

Have read and understood these Terms;
Agree that course content remains the property of Fornzix or its licensors;
Understand that course access is temporary;
Agree not to copy, record, distribute, teach from, publish, or reuse course content;
Understand that access ends upon course completion or expiration of the applicable access period; and
Agree to comply with these Terms.
